End User License Agreement (EULA)

This End User License Agreement ("Agreement") is a legal agreement between you ("End-User" or "you") and Big Much LLC, a Pennsylvania limited liability company ("we," "us," or "our"), for the Good Dopamine mobile application, including all updates, upgrades, and accompanying content and documentation (the "Licensed Application").

By downloading, installing, or using the Licensed Application, you agree to be bound by this Agreement. If you do not agree, do not download, install, or use the Licensed Application.

1. Acknowledgement

You and we acknowledge that this Agreement is concluded between you and us only, and not with Apple Inc. ("Apple"). We, not Apple, are solely responsible for the Licensed Application and its content.

This Agreement does not provide for usage rules that conflict with the Apple Media Services Terms and Conditions in effect as of the effective date above, which we acknowledge we have had the opportunity to review.

2. Scope of license

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Licensed Application on any Apple-branded products that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions, except that the Licensed Application may be accessed and used by other accounts associated with you as the purchaser via Family Sharing or volume purchasing.

The Licensed Application is licensed, not sold, to you. We reserve all rights not expressly granted.

2.1 Restrictions

You may not:

• Copy the Licensed Application, except as expressly permitted by this license
• Reverse engineer, decompile, disassemble, modify, or create derivative works of the Licensed Application, except to the extent this restriction is prohibited by applicable law
• Rent, lease, lend, sell, redistribute, or sublicense the Licensed Application
• Remove, obscure, or alter any proprietary notices
• Circumvent or attempt to circumvent the Licensed Application's blocking, shielding, or security features, or those of iOS
• Use the Licensed Application to develop a competing product
• Use the Licensed Application for any unlawful purpose, or to monitor or control another person's device without their knowledge and consent

3. Maintenance and support

We are solely responsible for providing any maintenance and support services for the Licensed Application, as described in this Agreement or as required by applicable law. You may request support at team@good-dopamine.app.

You and we acknowledge that Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the Licensed Application.

4. Warranty

We are solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed.

In the event of any failure of the Licensed Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the Licensed Application to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Licensed Application. Any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty are our sole responsibility.

Except as expressly stated above, and to the maximum extent permitted by law, the Licensed Application is provided "AS IS" without warranty of any kind. The full disclaimer of warranties is set out in our Terms of Service.

5. Product claims

You and we acknowledge that we, not Apple, are responsible for addressing any claims by you or any third party relating to the Licensed Application or your possession and/or use of it, including but not limited to: (i) product liability claims; (ii) any claim that the Licensed Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation, including in connection with the Licensed Application's use of the HealthKit and HomeKit frameworks.

This Agreement does not limit our liability to you beyond what is permitted by applicable law.

6. Intellectual property rights

The Licensed Application and all intellectual property rights in it are and remain the property of Big Much LLC and its licensors.

You and we acknowledge that, in the event of any third-party claim that the Licensed Application or your possession and use of it infringes that third party's intellectual property rights, we, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.

7. Legal compliance

You represent and warrant that:

(i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and

(ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

You further agree to comply with all applicable local, state, national, and international laws in connection with your use of the Licensed Application.

8. Third-party terms of agreement

You must comply with all applicable third-party terms of agreement when using the Licensed Application. This includes, without limitation, the Apple Media Services Terms and Conditions and the terms of your wireless data service agreement. Any data charges incurred through your use of the Licensed Application are your responsibility.

9. Third-party beneficiary

You and we acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of this Agreement, and that, upon your acceptance of the terms and conditions of this Agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary thereof.

10. Health and wellness — not medical advice

The Licensed Application is a general wellness product. It is not a medical device. It is not intended to diagnose, treat, cure, mitigate, or prevent any disease or medical condition, and it is not a substitute for professional medical, psychological, or psychiatric care.

Consult your physician or another qualified healthcare professional before beginning any activity offered in the Licensed Application that could affect your health, including physical movement, exercise, breathwork, or changes to your sleep or diet. Never disregard professional medical advice, or delay seeking it, because of something you have read or experienced in the Licensed Application. In an emergency, call 911 or your local emergency number.

The complete health disclaimer, including guidance for breathwork, physical activity, and mental health crisis resources, is set out in Section 1 of our Terms of Service, which is incorporated into this Agreement by reference.

11. Privacy

Our collection and use of information is described in our Privacy Policy. Your Screen Time selections and the content of your check-ins, reflections, and notes are stored only on your device; we do not receive them. We collect limited anonymous, aggregate usage analytics as described in that Policy, which you can turn off in the App. Data obtained through Apple's Screen Time frameworks is never sold, disclosed to third parties, or used for advertising.

12. Subscriptions

The Licensed Application offers optional auto-renewing subscriptions purchased through Apple In-App Purchase:

A subscription unlocks full use of the Licensed Application, including app blocking, the complete in-app activity library, the dopamine baseline score, daily and weekly check-ins, and learning resources. No free trial is currently offered.

Prices shown are for the United States; other regions are charged at Apple's equivalent local price tier. Subscriptions renew automatically unless auto-renew is turned off at least 24 hours before the end of the current period, and can be managed or cancelled in Settings → [your name] → Subscriptions on your device. Full subscription terms are set out in Section 5 of our Terms of Service. Refunds are handled by Apple in accordance with Apple's policies.

13. Termination

This license is effective until terminated. Your rights under this Agreement terminate automatically, without notice, if you fail to comply with any of its terms. Upon termination, you must cease all use of the Licensed Application and delete all copies from your devices. Sections 4, 5, 6, 9, 10, 14, and 15 survive termination.

14. Governing law

This Agreement is governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict of laws principles, except that this choice of law does not deprive a consumer of the protection of the mandatory laws of their country of residence.

15. General

This Agreement, together with our Terms of Service and Privacy Policy, is the entire agreement between you and us regarding the Licensed Application. If any provision is held unenforceable, the remainder stays in effect. We may update this Agreement; material changes will be posted with a new "Last updated" date and, where required, notified in the Licensed Application.
